You put the TM on your product and the sale of the product works kind of like back dating when you apply. It's called an effective date I believe as I have a couple of trademarks for a business I started after college. Here in the US, you have to prove that something is being used in commerce to get the registered trademark...I agree it seems kind of backward but I'm sure there are pluses and minuses that can be found with both systems...
