Considering that I Have neither listened to nor read the SC transcripts and am not a lawyer; however, in my experiences before the court as an expert witness must say that often a judge (justice) will pose the harshest or most difficult questions to the party that represents the side to which he/she is leaning, perhaps partly to help convince him/her of or "write" his/her decision. Given this, I tend not to rely on the give and take in the courtroom as an indicator as to where a judge/justice stands on the matter before the court.
