How can one be an affiliate of TEMN without a written agreement with TEMN?

In the absence of a formal agreement it's laughable to think that you were entitled to a shareholders' list any more than anyone else would be. By providing it to you it was a release of non-public information. Depending on its contents it could have been a release of material non-public information and subject to Regulation FD.
A release subject to Regulation FD must be released to the public. Is it ridiculous to think that a shareholder list must be released to the public to satisfy Regulation FD? OF course it is. But it is matched in its degree of foolishness by the release of a shareholder list to an unaffiliated, non-employee in the absence of an agreement that details the terms under which it is provided.
