I think they may try to find a way to reverse it without risking future de novo decisions. They don't want to throw in the towel on that before they have to, but they probably don't want to incur any more wrath from SCOTUS.

JUSTICE BREYER: Oh, you've seen the figures in here. The figures are they followed the path and they reverse non­stop and it's, like, 30 percent or 40
percent of all the cases get reversed.

They seemed none too happy in their exchanges with Mr. Phillips yesterday.

Maybe the fact that they brought up points for google that google didn't bring up will cause a reverse over impartiality.
They need to find a way out before SCOTUS goes on a nut with them.
