To me this one is pretty clear cut. I don't really even understand what we are arguing about. If the court that specializes in patent appeals determines that a lower court ruling needs to be reviewed it should have the ability to do so, and quibbling over whether the original ruling was based on fact or law is silly.

I have to believe logic will prevail on this one.

As a MNTA investor, I am much more concerned with the the post approval landscape regarding how much meat is left on the bone with > 50% of the daily copax users switching to thrice(and growing) and multiple daily generic players competing for what is left of market share.
