There was plenty of money to be made if DL could prove infringement. DL wanted as much money as he could get without committing a criminal crime. A civil wrong didn't matter, because it could be paid back, if necessary at a negotiated rate. A bird in hand was worth 2 or more in the bush so why wait, grab all the money you can get now in the event TPL loses the infringement case. In the event TPL wins, he pays back the money from future licenses at most likely discounted values. In the mean time he makes money from the non criminal theft of the partnership money and no matter what gets his control back when the debt is paid off or the compromised debt is paid off.
