Regarding potential release of JB. Some may be looking forward to a JB release. I shall put my data in a generic form. Let's say that the prosecutor realizes that he most likely will loose the appeal, thus causing the release of JB. Let's further say the the prosecutor has decided that the case is not worth retrying because JB has been the slammer so long and the management does not want to incur the expense of another trial. If these items are true (and I am saying they are or are not), then the prosecutor is in no particular hurry to move the appellate case along, in fact, the longer he can draw the appeal out before decision, assuming actions are taken with very little cost, then that is exactly what they are going to do. Personally, I think the prosecutor knows what he is doing. Even if he looses the appeal, he has won the incarceration.

To him that is success.

As far as the affect of this on the stock price of BORK....who knows. Look at this way.....a no release event scenario will not cause an upward pressure on the EPS or the PE......oh yah, the PE is ...ah.....
