I have stated that the 10-K is residing with the SEC and I stand by that comment. It was submitted, OBVIOUSLY, in the due process of the investigation, as Spongetech is working to clear its name.

It should not be a mystery to anyone that the SEC has requested and reviewed a copy of the document that will be the definitive piece of evidence as to whether the company will eventually be cleared, or not. To presume that the SEC would NOT have a copy of the document and would NOT give it a thorough review is to be very naive about the entire process.

The 10-K can be held for review by the SEC and "tinkereed with" for a while, as changes are requested and questions answered. SPNG is trying to cooperate with the SEC and to work within the system to get everything completed in proper order.

The delays in the release of the 10-K should not automatically be attributed to the company. Whereas there is no way to know definitively what the entire picture is, I can assure you that management is quite eager to get everything resolved and the final documents out into the public domain for full public view.

Like all investors, I await the release of the document and do not know when it will arrive. There is just no way to know this for sure since the ultimate decision does NOT rest solely in the hands of management.

Only upon its release will we, as investors, be able to make informed judgments as to the validity of past statements made by the company and by the bashers and only upon its release will the truth be known.

Until then much of what is being said is speculation and propaganda. Shareholder deserve to know the entire truth and they deserve to know it as expeditiously as possible.
