Last I saw the Whelan's did not own a single common share of BIEL, just all of the convertible debt which they convert at ridiculously huge discounts to market price at their own discretion. Of course they do this without any input from shareholders because the ridiculous articles of incorporation allow them to dilute at will, including raising the AS without approval. Regardless, none of this changes the fact that the company, and the CEO, has a fiduciary duty to act in the best interest of ALL shareholders, not just themselves.

None of this really matter though, because the more important point which has been consistently ignored is that if BIEL doesn't get these studies completed and published then the new FDA classification isn't going to mean anything because they won't have they data they need to get their product approved, even as a prescription device.
