Often time we read news stories about a reversal in rape and murder (particularly death penalty cases) convictions. While it is true that the reversal in these cases are extremely rare, but the appeal processes had exonerated many wrongly convicted individuals based on strong DNA evidence, strong evidence of prosecutorial misconduct and the strong evidence incompetent defense.

In the case on V v. G, an en banc review should be warranted on the basis of Wallach and Mayer flawed legal reasoning of "common sense" with regarding to the obviousness of the Lang's patent.
