Walrath was never in jeopardy of going to prison, having her standing in society destroyed and losing the 3 to 4 billion they had already made from insider trading so she played it down protect them pending a deal with equity. She knew they committed the crimes and still protected them and her Delaware court that makes their business in bankruptcy.

Put it another way, would you have liked to be in their position not knowing if the court was going to make an example out of you? Trust me, they had many, many sleepless nights during those two to four months.
