I don't believe the remaining claims were even challenged by La Jolla with a motion to dismiss. They mostly deal with breach of contract regarding La Jolla's practice of deducting the amounts owed to them under the debenture from funding they were providing under the EIA. WSGI feels they should have received the full amounts without paying off their existing debts to La Jolla.
