If the judge does not think the case is "plausable", then he can dismiss it.
The plaintiffs do not have to prove their case for it to be plausable, but they do have to pass that hurdle or it will be dismissed.
Judges dont want to waste their resouces on a case which has no chance in succeeding.
Apparently, Mr. Epstein/Mr. Olsen (shareholders) have, at a minimum, a "plausable" case. Its a milestone, as if we cant meet that, then we are toast.
In other words you are unlikely to graduate from Harvard Magna Cum Laude if you flunk out of 6 th grade...altho, a turnaround is possible..its just not too plausable.
