well he does reference "the lung cancer test" 8 times on the homepage alone, including the title of course . . . he's fine as long as he states "available soon", aka NOT FOR SALE . . .

from his PR:

"The company expects to seek FDA registration for The Lung Cancer Test for Early Detection™ in early 2015."

perhaps he thinks he can still sell it in 8 weeks in the states that allow him to . . . the federal rule should supersede the state rules . . . maybe this is the confusion . . . we'll see in 8 weeks . . .
