whatever the rules might say, the statement in the prospectus was false. And saying that the SEC rules are never subject to interpretation is belied by the immense body of case law devoted to the interpretation of those rules.

I am happy that there are voices on this board that balance the relentless criticism of LTNC, but defending the false representation in the prospectus doesn't help. Maybe it was carelessness and not deliberate, I don't know. But for sure the statement was on its face not true.
