warbil: The second, or as it referred to the "technical prong", requires that the complaintant prove that any of its own or its licensees' articles practiced the asserted patents. While proving infringement would automatically meet the test, as noted it can be proven by other means.

I believe, the ITC has misinterpreted the cited previous CAFC rulings on the subject, and their new interpretation will be overturned on appeal. JMHO
