Benzy will lose his bar licenses and will never be an arbitrator ever again as soon as the SEC complaint is filed and then the DOJ charges him with criminal counts.
He won't be arbitrating anything once he's a named defendant for fraud in cases that are public and searchable. Any arbitration decision made by an arbitrator who is under fraud charges would be appealable just based on that fact alone. No party would select or agree to an arbitrator who is charged with fraud, because it would make any decision by him susceptible to being vacated on appeal based on a claim of an incapacitated and/or dishonest arbitrator. Nobody would select an arbitrator with that baggage and then face the possibility that the whole arbitration would have to be redone with a different arbitrator.
Before a party agrees or nominates potential arbitrators, they research them to death trying to find out their inclination to the party's arguments. Pulling up civil and/or criminal fraud counts pending against a potential arbitrator would virtually rule him out.
