You don't seem to have much working knowledge about old mines. Or ore grades. Hand mining and processing in your backyard is much less economical than large-scale mining. Most of the weekend warrior hobbyists are reprocessing old tailings or stockpiled ore, and almost all lose money on the deal. The economics to mine their own rock are simply not there, regardless of permit status.
And I again suggest you read the extensive documentation about the Excelsior Mine. There are no old railroads, no passable roads, and no access to the mine workings. It lies in a heavily traveled, and very environmentally sensitive, State and Federal designated wilderness area. A single 4X4 traversing the area would almost certainly be noticed and reported almost immediately, much less any action at or around the minesite.
And your belief that amateurs could somehow identify, mine (blackpowder blast? Really?), remove, transport and process economic rock from an old mine is absolutely ridiculous.
