The court injunction says CWS can't do anything with the software. That is not an interpretation. The judgement reads
I think it is entirely possible that the new websites violate no "marketing," though, based on what I know about the software, I genuinely doubt CWS could realistically sell a functioning copy to anyone right now.
As for whether or not Dale actually has the software in his "greedy hands" - who knows? Either he has lied to investors or CWS aka WafR lied to Sandia or the NM courts. Sandia stated in their motion to put the software into receivership that

CWS did not object to Sandia's motion, so I think one can assume that they do not have the code, despite what Dale has claimed.
