When I was at the hearing, Judge Luckern kept saying that the transcript of the hearing was the matter of record for an investigation and that is why he had to be sure he got every statement exactly right.

Only arguments and evidence introduced in discovery can be discussed at the hearing and only arguments and evidence presented at the hearing can be discussed in review and appeal. That was my understanding what Judge Luckern meant.
