I think it is time for Newman to retire. She has completely loss it.
Her arguments do not make sense. She was the dissenting opinion and now she is trying to tell her fellow judges what they were thinking when they were making their decisions.

Nokia's claim construction as well as IDCC's claim construction was rejected by Judge Luckern in favor of his own claim construction.
Nokia did not appeal that decision. IDCC did. It was IDCC's appeal not Nokia's. The judges were right when they wrote that when Nokia's makes its appeal then they will consider Nokia's claim construction.
