Nokia and MSFT are trying to pull a fast one.

MOBILE OY’S NOTICE RE: COMMISSION DECISION NOT TO REVIEW AN
INTIAL DETEMINATION REGARDING SUBSTITUTION OF RESPONDENTS

On July 14, 2014, the Commission issued a notice that it did not intend to review the ID
(Order No. 116) adding Microsoft Mobile Oy (“MMO) as a respondent to this investigation. In
its notice, the Commission stated that “[on] May 20, 2014, Nokia and MMO moved to substitute
MMO for Nokia Inc. and Nokia Corp. …. On June 13, the ALJ issued the subject ID (Order No.
116), which substituted MMO for Nokia Inc., but not for Nokia Corp.” (Notice at 2.) These
statements are erroneous. Nokia and MMO moved to substitute MMO only for Nokia Corp.
(Mot. At 2.) Nokia Inc.’s status as a respondent was not addressed in the motion. In addition,
the ALJ did not substitute MMO for Nokia Inc. (ID at 8-9.) Indeed, there was no substitution at
all; Respondents understand that Nokia, Inc. remains a named respondent in this investigation.
The ALJ added MMO as a respondent, but declined to substitute MMO for Nokia Corp. in the
investigation. MMO reserves all rights as a newly-added respondent.
