What the VRNG-GOOG case does highlight if nothing else is the slow death of the value of many patents. Sure, if you are deep pocketed Google you can have your army of lawyers either defend or attack patents and have the luxury of time. As this is approaching 3 years in the courts, it shows that most companies and inventors (like Lang) could not defend a patent and thus stealing is unintentionally sanctioned. The courts HAVE to create a new IP arm where the judges and juries have a background in software code, molecules, etc. to judge fairly (maybe with spreadsheets vs. calculators with 9 digits) and have enough staff to get through any trial and appeal within 12 months. Rest of the world can do exactly what ZTE has done with impunity otherwise. In the absence of this, CAFC has to support the original finding because anything less isn't a blow to patent "trolls", instead it is a blow to corporate R&D spending, patent value, international respect for USPTO and entrepreneurialism.
