I am curious if they have enough tendered shares or if anyone (as in a fund) is holding back who might be against the deal's price?

I haven't tendered my remaining shares - Which are the ones that are at a loss. The cheaper shares I owned I sold into that news and realized that gain earlier on while it was higher than the offer.

Over all.... Gain against loss still leaves me a gain on the average however not what I am happy with as I think FIO sold out for way too low of a price.

For the first time ever I might join a lawsuit when I get that crap in the mail. LOL

Most the time I blow it off and don't include myself because you get very, very, little back - if anything, and it's a waste of time. But this one, to me, is a matter of principal.

We got hosed and Sandisk got a great deal. Sandisk is fully aware of that. They had FIO by the neck and they new it.
