Jim: In regard to "If IDCC paid that 3.6 million it will effect earnings", I believe IDCC previously expensed that cost when they set up a reserve in the first quarter 2013 after the decision was announced.

From first quarter, 2013 10-Q:

As of first quarter 2013, InterDigital has accrued a litigation contingency of $3.2 million related to its Huawei China Proceedings. InterDigital has no further obligations as a result of this or any of the other matters described in this Note 5 to Consolidated Financial Statements, and we have not recorded any additional related liabilities in our financial statements.
