Stover immediately tried to get the court to release DFMI from the lawsuit. Judge Gonzales stated "if I do that your case will be in a world of hurt and I won't allow you to reinstate a claim against DFMI." This stumped Stover and he asked and was granted time to confer with the other four lawyers. He then withdrew his motion to dismiss DFMI.
The judge then stated "I like giving lawyers enough rope to hang themselves." She went on to tell Stover that "you didn't win."
I found this puzzling and bizarre. I have never seen a judge give another lawyer advice on what they should or shouldn't do in structuring the case.
She then set the next step for this past Friday. I was not there this past Friday.
