License Notices/Reports

Licensees of HHS inventions (patents, software, biological materials, etc.) generally have an obligation described in their licenses to provide the NIH Office of Technology Transfer (OTT) with periodic reports on commercial development progress, licensed product or licensed service sales figures that show the calculation of earned royalties due, or invention utilization and research activities. Notices of milestone/benchmark events must be reported to the NIH OTT, generally within 30 days of when they are accomplished. Requests for waiver of the U.S. manufacturing requirement for licensed products sold in the U.S. must be submitted to the NIH OTT for approval. Notices of early license termination by the licensee and certificates of destruction for licensed materials must be submitted to the NIH OTT. In addition, licensees sometimes need to obtain consent from the NIH OTT for certain license-related transactions with third parties, such as license assignment, sublicensing the HHS-licensed inventions, and others. All such license related reports, notices, and requests for consent should be either mailed or e-mailed to one of the addresses provided below. If e-mailed, the NIH OTT requests that the report, notice, or written request document be provided as a scanned pdf attachment to the e-mail.
