My take is that no one expected anything different when Casper allowed the Markman to move forward. It was mainly just the formal acknowledgment of what everyone knew would happen... her decision made it obvious. Now, when a date is set... this will pop at least into the high .20s. In this current Market, there are not too many places you can make the kind of money you can make with WDDD. Think Treble Damages. The story here is so much better than VRNG and I like VRNG.

I believe Susman Godfrey http://www.susmangodfrey.com/Types-of-Cases/Intellectual-Property/Representative-Patent-Cases/ agreed to move forward because they can use refiling as leverage in settlement without having to restart the clock. Also remember, they are covering their own costs here and get paid only when WDDD wins.

In a nutshell, Casper did nothing to WDDD with her SJ ruling except possibly give incentive to both sides to settle... kind of a warning shot... I still am very confident in WDDD getting at least a partial payout from the 'temporarily lost patent years' on top of the cleared patent years and treble damages by a company that WDDD had offered a licensing deal to...
