In a nutshell, the exhibit offered of Bendel Feed v. Seaboard Corporation, the point to be made and how it relates to our case is in the summary opinion starting on page 18 with "The Court observes that..."

My favorite line: "The only thing the Court finds confusing is the Petitioners' unseemly attempt to avoid an arbitral resolution of this matter. Further, I direct that any additional litigation initiated to stall payment of a valid obligation be referred to me and note that in such event, sanctions are a likely consideration. I find that the Panel did not abuse its discretion..."

And further in that paragraph, it is stated: "I am mindful that the law requires that I confirm the Panel's "decision [if it] is plausibly grounded in the parties' agreement," even if, in my opinion, the Panel's decision is "very incorrect.""



This case was in the Southern District of NY.
