I have also seen dockets added very late at night or next day but met the filing deadline when reviewing the text.

Plaintiff attorneys tend to file early because they a normally facing a specific deadline. I have been involved in a case in which the bad deed occurred too far back.
Counsel representing a defendant tends to wait until the very last minute to file. MO is to stall.
Alternatively, there could be settlement in the works?
Lastly, don’t hold your breath!

The Receiver's request for an extension of time to respond to the motion to strike by Defendants Feinsod and Feinstein is GRANTED, over Defendants' objection. The Receiver's opposition to the motion to strike shall be filed by 1/18/23.
Defendants may file a reply by 1/26/22. In light of this scheduling, the Court is temporarily holding in abeyance any further briefing on the parties' summary judgment motions. However, absent good cause shown, the Court expects the parties to adhere to the dates set forth in the 11/19/22 scheduling order with respect to Daubert motions.

The Receiver and Defendants Sommer, Singer, Boockvar, Indick, Wolpert, and Laird, have reached a settlement in principle which will resolve the claims between the Receiver and Defendants Sommer, Singer, Boockvar, Indick, Wolpert, and Laird. These are Independent Directors.
Daubert motions and motions for summary judgment must be filed on or before 12/06/22, the opposition due 1/24/23, and replies due 2/21/23.
Extending the deadline will also enable the Receiver’s motions to be streamlined as to the two remaining defendants, Michael Feinsod and Richard Feinstein.
