Though I haven't bought in for a while, I had NO trouble with Fidelity in my years of trading Pennies!! If they are the guilty ones, call and ask for a supervisor, or a Trader, either might help you out?

Nothing public I believe. I can't recall any past court filings after a conference Call. But I know the joint status report has to be public. I think it all depends on if they have agreed on something after the call, or if it was just to inform the judge. Wish we were there

I agree with mist but for the fact that there has been a settlement reached with some. I don't believe this is going to take much longer. I courts at some point will ask that both parties come together and if theyvdobt, there will be consequences. I know this from experience. I believe if not in February, very soon after.
I finally have an answer to a question that has been vexing me for months -- why did KK/C&C choose the settlement route over the assured slam dunk on appeal in the Federal Circuit? There were several components to this question. An affirmative appellate ruling would have been applicable to the entire industry, not just the current list of defendants. Punitive damages (up to triple the actual damages would have been in play) with the appeal. And the timetable would have been reasonably well prescribed in the appeal process, not open-ended as it appears to be now.
I received the answer from an authoritative source last night; my mind can rest and I can resume my slumber. I will share however.
The amount of damages (real, punitive, and their accrued interest) would have been so large that it would have put many of the companies out of business and they could have filed bankruptcy to get out from under the decree. Yes, GERS would have received some liquid cash and probably have to take over and sell some ethanol plants, but they would never get anywhere near the judgement. And, of course, all of this would take time. A settlement however would bypass this conundrum but finding the boundary of what can and will be paid is a painfully long process.
So the path to settlement was required because the amounts of back royalties due etc. are very large and this confirms speculations to that effect. Also, since there are many parties and personalities involved (i.e. DVG) this settlement path to finding that boundary that all can accept will be very long. Expect another request for stay in February.
With my mind clear on this point and the knowledge we are likely not near anything substantive, I return to my den -- outside Whitehorse. And you think you are cold where you are? You do not know cold!
I know... but hey, a settlement of $5 to $10 a share based on the agreement between CC and GERS seems not so strange. I don’t know if that would bring the SP in the same regions (based on the share structure) but would it be way to high?

Totally agree. Those who have watched GERS closely the past years, noticed somthing HAS changed since the last RS.
No dilution anymore for many months.
And a PPS that went up instead of down, indicates a lot.
Of course, we can not for see the future. But there is a reason why things are different now. Those who do the math, will see this history is behind us, and the future will be a whole new story.

A Cardinal's Confession...DEF 14A

Our operating agreement currently provides that the consent of a majority of the total outstanding membership units entitled to vote is required in order for the Company to confess a judgment in an amount in excess of $500,000. The Board of Directors has concluded that it is in the best interests of the Company to amend the operating agreement to remove this requirement and permit the Board of Directors the flexibility to enter into confessions of judgment on behalf of the Company as part of its authority to manage the business and affairs of the Company.
Accordingly, it is proposed that the Company amend Section 5.7(b) of the operating agreement as follows (crossed out language reflects the change):

"DEFINITION of 'Confession Of Judgment' A written agreement signed by the defendant that accepts the liability and amount of damages that was agreed on. A confession of judgment is a way to circumvent normal court proceedings and avoid a lengthy legal process to resolve a dispute."
According to Cardinal's latest 10-K, the only pending "legal proceeding" is the patent infringement lawsuit. Therefore, the need for a "confession of judgment" can only mean one thing...

GERS... What are you talking about? The O/S amount is between 19-20 million shares, which is well within a reasonable amount? Just because they had some R/S's in the past, (I went through a number of them,) doesn't mean they are to continue on!
After the Publication of the Settlement, there should be NO MORE talk of R/S's period!!! IMO..
GERS has probably seen its last RS? History tells us, you can’t believe that...

That post was designed for potentially new BTZO Investors who focus on that Triple zero figure too much? When you have 7.2 Billion Outstanding Shares, as Dutch pointed out, there will have to be one or two huge Reverse Splits in the offing as it looks now! Many newbies will be disappointed beyond imagination when that happens!
Just to point out that Gers has probably seen its last R/S, and while big profit-taking will occur from time to time, it is still the best bet in the P-Stock field IMO??
But then again, I don't follow BTZO, so I don't know what they have to offer? But staying at that .0001 mark so long makes me think their prospects for the future are not as bright as those of GERS?
A conjunctive relationship between GERS and BTZO may be in place, but I don't know if it will make that much of a difference for BTZO Investors when the Settlement comes out!

The gap is what is important! I am not here everyday so excuse me for the error! How about remarking about that wide spread, not just fiddle over the amounts, Right? The wide spread and the larger BTZO O/S, 7.2 Billion, which I saw as about 4.5 billion just recently, is what is tremendously important for future Investors!
One of the effects of that number is that it will require a tremendous number of share buying to budge BTZO upward even a point! Then that elevated position will be very fragile, and can easily be pushed downward!
All BTZO Investors will be "Saddled" with that crazy high O/S, which may even be larger this time next week? Then, the low amount of Gers O/S's will help Gers move forward with far less share buying taking place once the profit-taking settles down! GLTA...

Gers, If there is any comparison to be made, it is in the O/S count! While Gers has somewhere near 15 MILLION, BTZO has a whopping total of about 4.5 BILLION, yes BILLIONS!
Yes, Gers had an R/S when we had about 2+ Billion O/S's, can you imagine the R/S BTZO will have, now standing at about 4.5 BILLION shares outstanding? ....and yes, it sure appears that they will have one, and sooner than later IMO... GLTA...
'The most' might be depending on a lot of things, but the highest chance publicity and a direct connection with the money will be at GERS. I see BTZO more as collateral. But still, it seems like a nice chance to make some money on the hype that will come...and who knows where news will take it.

Since the Patent's and Law Suits were under GERS, and its in there favor, I'm dumping BTZO, and stay with GERS, Think that's where the most money is to be made.
So, there is Flux Carb Corp (FCC), Pervasip Corp (PVSP), Bitzio (BTZO), and GreenShift (GERS).
They have preferred shares, swapped/traded/sold/exchanged privately.
We common folk can buy the common shares.
In 2016 they did a transaction merging GERS/BTZO; but they haven't done anything to disposition the shares.
What are the options?
Reverse of BTZO and conversion to GERS, Dissolve BTZO, abandon the shell?
I'm asking because a lot of money changed hands with the recent volume of BTZO and GERS; but effectively they are the same.

I have been in and out many times(to save the shirt on my back). Always spot check GERS every now and then. Started really reading about 2 months back and became intrigued to say the least. Bought some one more time and sold some to make sure it is a free ride this time, did not want to take any chances.
It is already much higher than I bought in for. Went to 24 cents and I was really tempted. Maybe some others needed a free ride also. The history of GERS is a little brutal to say the least.

Gers. regardless, some investors will "WANT-IN" in no matter what, even for the long term with a Company in an excellent sector and on the move, and a Special Situation that Looks Like a great deal of money will be placed in Gers's hands!
If, yes if, many of the Infringing Co's become Contractees for an unlimited period of time, it will make GERS seem like a Growth Company with a great future ahead! Once contracted with GERS, who has advanced systems to take the place of the old ones, that will greatly narrow-down the competition, and keep GERS progressive for many, many years ahead! That is just what ALL Investors want to see...long term stability and growth! Of course, Blips will occur along the way, but a continual increase in profits makes Investors drool for a chance to become involved! Long term also means Institutional Investment Companies becoming involved when a stock reaches 3-5 Bucks a share. and that is very possible with Gers over the next undetermined period of time?
Then with debt pared-down to a livable figure, and the O/S share count remains around 20 Million shares or less, Gers becomes a highly sought after Company to Invest in?
Then, since so many Co's are either cyclical, fad related, or bedraggled with competition from every angle, Gers can become that Bread and butter Stock in peoples' minds, where they will always have something good to offer in the Alternative energy sector, and without much competition in the area they are in as well? Though we have only shown an inkling of that so far, Gers could remain Rock solid over the next so many years, making it highly regarded in the Investing public's minds! In my opinion of course, but I always look for long term stability and Innovation, where the Company's long term positive nature overpowers the traders and naysayers! People tend to stay with a Company like that! I hope that is where Gers will become, then remain in the Publics' mind? GLTA..
I think it will be really hard now to get in again below 0.1 and also I think the ask at 0.15 will be very thin. I don't have level 2, but I think it will not take a 100,000 shares to get us back above .20
There are always shaky hands in the Penny area, especially when so many losses occur over the years? But this sell-off, and I felt it coming like so many others, only narrows down the Investor field somewhat, and gives others, at such a propitious time, to get in on one of the potentially greatest Penny Plays of the last 20 years or so, maybe EVER? Now the new buyers will see fewer sellers than before, making the way for large PPS rises in the future too! What a time to buy???
