Surely the rate that you have applied for a Nokia 3g contract would be based upon Nokia having the same sales volume in 3g as it had/has in 2g. At present the difference in 3g sales is not large. Are you of the opinion that if S/E signs for 3g, say in the next 6 months, then Nokia would obtain 50% of the applicable rate, or do you feel that the rates would be similar.

Another 2+ years to determine if E/SE is a trigger? Wouldn't the 3G contract have the same language as the 2G contract and end up with the same result, only MUCH SOONER?

CB- Part of my continued investment premise is HG's use of the terms watershed and integrity were not only 2g. If that is what he meant I'll agree they're overcompensated.

Again, we must look at the strengths of IDCC's position. Nok will be unable to stall for 2 years if E/SNE licenses because the trigger issue has already been decided by the ICC. All IDCC has to do is create more tiers to the 3g rate schedule and Nok is out of arguments.

Either Nokia is lying through its teeth, or they truly want the court to approve "Design-Around" phones.

If they're being truthful, Nokia will need to wrap-up Delaware soon, rather than two years or more from now.

Based on comments by engineers/lawyers on the board, I find it hard to believe that Nokia could design the new phones, produce and test prototypes, get a favorable court decision that the phones won't infringe older and newer patents, and launch an advertising campaign to meet the crucial 2006-Xmas selling season, which is only 17 months away.

If they're not being truthful with the court, I'll see 'ya in two or three years.
