Or instead of Trustee, JMW allows a shareholder meeting to be held, BOD gets tossed, Weil/Rosie gets tossed, SG takes over for the debtors. Provided the good guys have enough muscle to toss the BOD. Maybe the Trustee is better.

Agreed on almost all points byrddog.

Especially so since IF the POR is dead, and we work under a new DS and POR at least marginally directed by equity, and with the goal of coming out as a viable holding company of some kind - many of the groundrules we have been living under change.

The biggest one (To my mind anyway) is that - IF the company is going to exist as a viable, continuing entity capible of generating revenue, and with NOLS enabling 'us' to hold onto more of that revenue - Why should the bondholders be paid and liquidated at full face value 'now'?

If the terms of those Bonds give us years to pay them, and if the interest can be paid on them 'now' to get them current, then WE get to hold onto the cash value 'now' that underwrites those bonds and use that cash to increase the potential value of the resulting emerged company.

I'm no lawyer. I'm no high-end businessman. But I often have a touch of common sense and logic.

We just have to get back in charge of running this show first. Settlement may happen first IF we look like that's what we are heading towards as a viable business concern - but we'll see soon enough I suppose.

The only thing that concerns me is that the other parties outside of the EC, Debtors and SNHs don't seem to be on the same page. The 3 majors excluding TPS all wanted oral arguements. I am hopeful of your scenario but I am cautious as to the settlement prior to Aug 3 or 15th because of the reason above unless the EC and Debtors agree to payoff all creditors according to the current POR.

byrdog i agree ,what proved to me the por was useless was when the snh agreed to give us everything they orchestrated in that plan for themselves ,and the judge knows this also

Not bad Byrd.

Thanks for the summary of possibilities. I am opting for your last paragraph result but that will only happen if the two instigators here(JPMC/FDIC) pony up with a LOT of cash to appease SG. Otherwise the S is not happening. SG really wants to get them in DC(for all the moola),imo. It is as plain as day what SS's motives are.
