I just received the following email from Sam Stevens, of HM Court-service in the UK.
"The trial date was never May, it was a mistake on the website. It was originally July and then moved to October. Sorry if the website has caused you confusion."
Loop: I tend to agree with your thoughts on the suspension so that the parties wouldn't be spending alot of time and money until the damage issue became clear.
However, I reread some of my posts when the lawsuit was first filed and I don't understand why IDCC couldn't have continued discovery on it's "failure of consideration" theory in preparation for a MSJ. I would think they would want this issue resolved before they even consider arbitration.
