GAB

I do not know whether they have a MFL relating back to Nok. I do not think it matters. As Mschere has pointed out, Ericy owes a substantial sum for W-CDMA infrastructure when they decide to license 3g. If MFL 2g discounts are contingent upon Ericy/SNE signing and paying for 3g licenses, then I say bring it baby. If we suddenly have Nok, Ericy, SNE and Samsung licensed and paying for 3g, watch our analysts work and refigure expected revenue over the next 5 years. Mot will have no choice but to follow suit along with many others. We can change Jim's last name to Geniousio and attend celebrations for a year or so.

GAB: Neither the Ericsson nor the Sony-Ericsson licenses have a MFL clause. In any event MFL clauses are not retroactive.

Loop...Do you think the ERICY agreement contains a reopener clause that would permit ERICY to renegotiate rates if NOK got a better 2G deal than they? If so, would it be retroactive to amounts previously paid.
