Maybe they just didn't want to risk a slip up statement by an Officer while the arbitration panel is deliberating and closing briefs are still due.

Any statements about SE and E as triggers for Nok 2G are probably just in keeping with and reiterating IDCC's official position at the arbitration i.e. not indicative of any ruling by the panel.
