I believe the risks to the MM's would be unbelievably high if this ever reached a jury. In fact, if Posner and her team ever got into the books it's hard to tell what other dirt they'd find that's effected other companies. I think their risk of many more suits, and SEC involvement would be great.
I think Posner and LP are playing hardball, but I don't believe they'll want to wait the additional years it will take to reach a jury trial. With all the time and personel Posner's using on this case I've got to believe that her office will see up to perhaps 40% of the settlement, but I still believe that NWBO will see hundreds of millions, or more.
If we did go to a jury trial, I'm guessing it could be late next year or 2027, I believe the company's success will be assured. If I'm right about that, even a multi-billion-dollar settlement then wouldn't be worth as much to the company as hundreds of millions today. I don't doubt a jury could reward such a settlement, but if they did, the 7 MM's could probably appeal for years. A settlement now would be far more meaningful, even if everything is covered in confidentiality agreements.
