This Amarin vs. Hickma case affords the S.C. an opportunity to clarify how to deal with prima facie evidence(i.e. should prima facie evidence be considered at the same time with secondary indicia?.... or should prima facie evidence be considered first and then secondary indicia only afterwards?)....plus what constitutes proper consideration of secondary indicia(i.e. should negative secondary indicia be weighed against positive secondary indicia?)...These important principles in patent law are up for clarification by the S.C.
