when you mention that the trial court was overruled on the malicious prosecution...wasn't that limited to pursuing a Malicious Prosecution against the "named plaintive" alone? I don't know if that case law stands from 2012, but it does appear at that time in the jurisdiction of the California Court of Appeals, the class action attorneys of a suspected frivolous lawsuit could become defendants of a Malicious Prosecution lawsuit.
