What actions might that be?

Yes TTCM reported a timeline, but do you really think they can meet it right now? I don't!! I think the lawsuit has put a slight wrench in TTCM's timeline. So when you say "accountable for their actions", yeah I agree; however, it's not management's actions that need to be accounted for. It is a certain other person who need to be held accountable in my opinion.

As far as you stating that they

have grown ever quieter

once again what are you wanting from them? It should be easy to see that until this lawsuit is settled, TTCM will not ink a deal, but who's to say they are still not working hard to do so? IMO once this asinine lawsuit is out of the way, it may only take days before we hear ever greater news!!
