And perhaps that is what they are banking on and not that eager about raising PPS near term so funds and institutions won't have shares or a vote (and hence the means to bring about a lawsuit)

The market "demand" is what they may be counting on to elevate PPS in a buyout attempt. Hey, they'd save on uplisting fees / time requirements etc.

** Could be that Joe T and Valvo were in the go it alone camp and got voted off the island because of it ??

I bought a lot of this company's stock based on the representations they made publicly via their website and press releases. Specifically, they represented certain milestones. At no point have they so much as insinuated that they will not meet those milestones as represented. They have a fiduciary duty towards me as an investor to act in good faith with my investment. If they intend to deviate in any way from the milestones which convinced many people to entrust them with their money, you can rest assured that there will be lawsuits.
