That is the plan but courts still have the power to over rule patent law. The 045 and 690 patents were amended to have the "specific reference" but the patent was issued before the april 2000 effective date(rule 120 I believe). The uspto states that all active patents should all abide by this but the court can over rule it still.

Highly likely worlds will get to have a markman imo.
