I heard the Florida Bar is investigating Bernstein for his involvement in this penny stock pump and dump. He's reading and okaying all these inflated press releases. His advice to omit the pump from the 8-Ks is a sound plan, but the PRs are still actionable as a matter of law. The problem is Bernstein's not just dishing legal advice, which would be fine, but he's allowing himself to be represented as part of the advisory group and part of the company. That's what they're looking at. The involvement is a bit too close for comfort.
