We should be able to take some comfort in thinking that anyone appointed by the Federal Courts to serve as a "Special Master" performing Markman Review's would certainly have to be fully informed of the appeals process as well as the standards used in such a review. He would not be worth much to the lower courts if his claim constructions tended to be reversed on appeal.
