15 CPSS has defined a fail as "a failure to settle a securities transaction on the contractual settlement date, usually because of technical or temporary difficulties." "A glossary of terms used in payments and settlement systems," at 18, CPSS (March 2003).

It will be interesting to see how the SEC/DTC/NASD determine what of the invalid shares have actually "settled"

yes most who bought 4 trading days before the Suspension should have had their trades theoretically "settle", but given the fact that these shares, are being proven invalid, have these transactions really actually settled? hmmm... lets see what the DTC says.
