I work in brand marketing. Adding a TM to a trade name is free and somewhat meaningless.

Filing the TM for a registration approval within the industry category, if approved, yields the R in place of the TM and contains legal teeth.

This is suggested but not an immediate necessity weighted against other greater priorities in a new business start up. It may also be in process as it can take weeks to get the approval.

The fact there may be other businesses with the same name is somewhat meaningless too dependent on the industry SIC in which the two businesses operate. Such as a marina vs. social media website.
