Its different because top 40 content isn't freely available over my internet connection (illegal file-sharing sites aside).

Its the digital part that I would think would worry the labels the most. Not many people would think of recording from a traditional radio because of the poor reception and quality. Digital radio's crystal clear quality changes all that.
