Bakerman re: Markman/Tantivy

Warning: Below is purely my non-legal speculation:

I expect that the next major milestone will be the filing of a draft written report (Markman Report?) by the court's expert, Richard Egan.

In preparing his report, Mr. Egan may request additional information from the parties.

The draft report may include several findings and conclusions about the use of terms, claim construction, etc.

Then each side will probably have an opportunity to make comments on the report before it is finalized.

Then the judge will use the report to render a decison.

When the draft report comes out, we may have a pretty good idea of where the case is going to go.

Somewhere along the way, there may be a settlement.

Again, JMHO.
