The jailhouse lawyers are running amok here.

There was no court case in Japan it was a preliminary finding issued by a government agency much like the FTC in the US. The next step would be a hearing where Intel could present evidence and argument. It did not have that opportunity before the JFTC.

Intel chose to accept the finding and end the matter. Microsoft chose to take the finding to the next level and challenge the issues raiised.

Second, the JFTC was an administrative law or civil matter as is the case with the FTC in the US. Using concepts from criminal law such as No Contest is abosolutely ridiculous.

Third the legal system and law in Japan is quite different than in the US. Drawing idiotic analogies with US law does not lead to a true uunderstanding of what the JFTC did in Japan.
