Don't you think that our Trustee should have been able to negotiate at least a little recovery for Class 5?
Class 5 has $15.284 B worth of votes.
I am really surprised - under this deemed substantive consolidation - that Class 3 can take distributions made to Class 5 from other Debtors' estates that they have no claim against.
I may be incorrect but I see it as a Breach of Contract.
Our contract is with LBHI and our obligations to the Senior Notes is against the estate of LBHI only.
